Here are a few violations that occurred at Waco.  All violations I have listed are based on unrefutable evidence that criminal acts did occur and should be prosecuted.  There are many violations I have not listed. 
Violations Committed by the FBI & ATF

Falsifying Warrant Affidavit

Reckless Endangerment 

  1. Agents shot indiscriminately at children, women, and men.  Paul J. Smith (sniper) said, "I didn't see anyone shooting at our people."  Smith said, "I just started shooting at those windows.  I put 30 or 40 rounds in there."  Mark Murray (agent) said, "At no time did I see any occupant, other than shadows moving."

Harassment/Disorderly Conduct

  1. Federal agents gave the middle finger, and dropping their pants and bearing their butts in front of woman and small children.

Criminal Mischief

  1. Agents wrote on the church windows.

Excessive Force Resulting in Death 

  1. 76 ATF agents, 3 blackhawk helicopters, and a command post. 
  2. Use of excessive amounts of C.S. gas for at least six hours.  Experts say the effect of C.S. gas on children would probably be FATAL, and the effects on adults are:  eyes close, burning of the skin, eyes, nose, and throat, choking, chest pain, vomiting and severe respiratory problems, and nausea.
  3. High explosives (pyrotechnic devices) were used.  
  4. Mutalation of Jimmy Riddle by running him through the tracks of the tank.

Purjery 

  1. Louis Freeh stated, "No shots were fired by any federal agents."   FBI's Richard Schwein said, "Not one round was fired by an FBI agent during that tragic day."  Richard Schwein's attempt to be deceptive has some truth to it......there was not just one round fired, there were many rounds fired by agents.  Experts and scientists have confirmed the flashes on video are gunfire. See the FLIR Project. 
  2. FBI lied to Congress and to the American public for six years about the use of pyrotechnic devices, use/presence of Delta Force, FLIR footage, their possession of audio tapes.

Violation of Posse Comitatus

  1. This is a criminal statute which forbids the use of military personnel and equipment to be used in domestic operations (except for drug interdiction).  FBI allowed/requested delta force to assist.  FBI's Byron Sage personally admitted to me that Delta Force was present.  A Combat Applications Group confirmed Delta Force was SHOOTING at Branch Davidians.  CIA's Gene Cullen attended a CIA meeting, where plans were made to have at least ten (10) Delta personnel at Waco who would participate in any type of operational or tactical effort against the Branch Davidians.  Military tanks and helicopters were also used at Waco. 

Destruction of Evidence

  1. Evidence was destroyed with water and bleach
  2. Bodies were placed in a refridgeration truck without a power supply to refridate the truck
  3. Concrete vault was bulldozed
  4. Concrete around the hole from the high explosives vanished
  5. Four tapes from video cameras pointing at front doors vanished
  6. Activity log vanished
  7. Front door vanished.

Violations of Branch Davidians
 
None, according to the local Sheriff, who conducted a full investigation prior to the ATF assault.  David Koresh was cleared of having illegal firearms.
 
The child abuse allegation was fabricated.  I observed David Koresh practice strict discipline, but I never observed child abuse.  However, there is no federal statute for child abuse.  Child abuse is dealt with on a state level.
 
The unfortunate death of four ATF Agents has always been controversial.  The question of were they murdered lies heavily upon two important questions - who shot first and why?  More than one witness claims the ATF shot first.  Evidence shows the ATF shot unarmed individuals.  If the ATF shot prematurely without reason, there may have been justification for the Branch Davidians to act in self defence.  If the ATF did not shoot first, why have they concealed or destroyed the video tapes that give the answers to these questions.

Fire Accelerants
It's unknown who started the fires.  There were at least three fires started at the same time.  There is evidence that one of the fires may have been started by a Branch Davidian.  However, evidence also indicates the other two fires were started from federal agent accelerants listed below: 
1) Use of Pyrotechnic Devices
2) Use of C.S. Gas
3) Propane Bottle Explosion
4) 1200 Gallons of Hydrocarbon Fuel Dumped 
 
The award winning documentary filmaker, Michael J. McNulty, and the C.O.P.S. organization uncovered evidence from the Texas Ranger evidence lockers.  They found six pyrotechnic flash bang grenades that had been used by federal agents against the Branch Davidians.  The six pyrotechnic devices were mislabeled as silencers or gun parts.  Two pyrotechnis devices were used in the southwest corner of the building, two were used in the dining area, and two were used in the chapel.  These are all three points of origin of the fire according to the Texas Department of Public Safety. 
 
Colonel Jack Frost stated, "The flash that resulted as a detination of this charge can cause a fire in any area where there is a high concentration of volital vapers."
 
The C.O.P.S. organization conducted an experiment to test the flammable vapor in C.S. gas.  The results revealed C.S. gas will not ignite in a concentrated form or while it is still in a container.  However, it is flammable in a less concentrated form.  For example, C.S. gas is flammable when it is sprayed from a can, which was the method of dispersment at Waco.
 
A propane bottle located outside of the building, near the dining area
exploded.  This explosion was the largest fire that can be seen in the video footage.  The propane tank had a perfect circular cut around the middle, and it appeared someone had used a torch to cut the top off.  According to Sergeant First Class Steven Barry (U.S. Army Special Forces, retired) and Colonel Jack Frost, the evidence indicates the explosion of the propane tank would be consistant with the use of Detination Cord.
 
Evidence proves that federal agents dumped 2000 gallons of Hydrocarbon fuel from fuel tanks belonging to the Branch Davidians.  The fuel was dumped near the Branch Davidian complex, and would have been an accelerant to the fire.  This information is evident through negotiation tapes, federal reports, video footage, and eye witness accounts.
 

What about HOMICIDE?  The evidence speaks for itself.  Watch the documentary, Waco: A New Revelation.  Read or watch the FLIR Project, and read my letter to Congress.  The bullet that took my mothers life entered her back; this was not a suicide.
 
An anonymous FBI forensic crime scene analyst stated, "The majority of the people, the bodies that I saw...were clear cut homicide victims." 
 
Several experts and scientists concluded the flashes on the FLIR Project was, without a doubt, gunfire from federal agents.  Quite honestly, even a child would be able to determine the flashes were gunfire by looking at the FLIR Project.
 
When I met with FBI's Byron Sage, I asked him why they inserted massive amounts of flamable C.S. gas for six hours.  You won't believe his answer!  Byron Sage said they assumed everyone would come out or let their children come out.  Even a deformed assumption such as this should have only taken minutes to conclude - it's not working, it's not safe, and their not coming out.  Byron Sage further stated, they inserted C.S. gas for this period of time because there was an opening in the wall that created a breeze and the gas would not have been effective.  So why would they continue inserting the gas if it was not effective!

 I have served many warrants without the use of 76 ATF agents, without blackhawk helicopters, and without a command post.  Serving a warrant usually requires one or two additional officers.

As a police officer, I can honestly say the incident that occurred in Waco, Texas, destroyed the public trust, and it was an embarrassment to law enforcement.
