Circumstantial Evidence:
An undetermined number of bodies with one or more gunshots were found in the areas where FLIR footage indicates federal agents directed their gunfire.
Forensic Evidence:
The medical examiner determined the cause of death for several Branch Davidians was one or more gunshots to the back side of the bodies.
Testimonial Evidence:
1) FBI Special agent, Charles Riley, stated in his after action report that he
had heard shots fired that morning from sniper position #1 (Sierra One).
On April 19, 1993, agents were positioned in three locations identified as Sierra One, Two, and Three. According to the on site activity log, at 9:03 am, FBI command advised Sierra Two that an unknown subject could be seen traveling on foot at the back of the building. The log indicates that Falcon Two
and FBI helicopter took off to intercept the subject. Several flashes can be seen coming from the helicopter as it approached the building.
2) Dr. Edward Allard, a former supervising scientist in video and television
imegery at the U.S. Governments night vision derectorit, examined
the FLIR footage and concludes that the flashes are gunfire. Dr. Allard
stated, "It's clearly machine gun fire from a helicopter. There is
absolutely nothing in nature that can cause thermal flashes at a 30th
of a second."
On April 19, 1993, at 12:10 pm, FLIR footage shows at least two automatic weapons being fired into the back of the burning dining room, which was the only undamaged exit from the building. According to the Justice Department report, at least fifteen people were found shot to death at this location. Dr. Edward Allard reviewed this FLIR footage and stated, "What we have is we have men firing automatic weapons and their firing into the burning building like some kind of cowboy movie, they're retreating down the building and firing as their retreating. I can not remember something more sickening than I had to do to witness this."
3) FBI Special agent, Charles Riley, stated in his after action report that he
had heard shots fired that morning from sniper position #1 (on the
ground). This position was occupied by snipers led by special agent Lon
Horiuchi. Horiuchi stated that neither he nor his snipers fired their weapons
on April 19th.
Four (4) expended shell cassings were later found at Sierra One (position #1). The ATF had also been in Sierra One on February 28, 1993. The FBI refused to submit their guns for balistics testing to determine if the expended shell cassings were fired from thier guns. In 1992, Horiuchi also shot and killed Vicki Weaver and was charged with manslaughter but never tried. (Vickie was holding her baby in the window of a door when Horiuchi shot her).
4) Senior Case Officer, Gene Cullen, Special Operations Group of the CIA
stated, "There is no doubt in my mind that the flashes on FLIR tape
was fired from a semi automatic or automatic weapon fire being
returned into the building. I mean it's inconsistant to even think
otherwise. There were people there on the ground with automatic
weapons, and flashes such as that only come from one thing, and it comes
from rifle barrels that are firing back into the building."
5) Sergeant First Class, Steven M. Barry, U.S. Army Special Forces, retired,
stated, "When you see the individuals roll out from the tank and come
around to the sides and start shooting into the building, what they're doing
is they're defending the vehicle."
6) An anonymous former FBI Forensic Crime Scene Analyst stated, "I don't
know who fired bullets into these peoples bodies. I don't know from what
origin the bullets came from, so if we could agree that we do not have a
definitive answer of the sourcing that infact what we have is an open
homicide. Some of these bodies exibited characteristics of perhaps being
shot." "The majority of the people, the bodies that I
saw...were clear cut homicide victims."
7) Captain David Byrnes (Texas Rangers, retired) stated, "The information
that we've always been given was that there was no federal agent gunfire
on the day of April 19th. Well, in reviewing the photographs and the
statements, I would say there are some questions that need to be
answered. The fact that agent Horiuchi stated in his 302 (statement) that
the sniper at Sierra One, which was the undercover house, did not fire, and
there is an expanded shell cassing there visible on the floor would also raise
a question."
8) Dr. Frederic Whitehurst, a former FBI agent for 16 years, who work for
12 years at the FBI Crime Laboratory in Washington stated, "If someone
comes to me to understand the data, I need to tell them the uncertainty
associated with it. If the government is only telling them this is not a field of
fire, well the government is refusing to look at this, and anybody with their
plain eyes can see, well, something's going on there. You know when you
think of the fact their shooting automatic weapons fire into a
building with children in it, there's something wrong."
On April 19, 1993, several women and children went inside an old concrete vault (commonly referred to as the bunker) in an attempt to survive the C.S. gas. Unfortunately, those women and children did not survive. Various types of evidence indicate that a shape charge (demolition explosive) was used by federal agents to penetrate from the outside of the roof downward through the concrete vault. This shape charge killed and dismembered the women and children inside.
In an interview with FBI's Byron Sage on February 12, 2003, he told me, on April 19th David Koresh was in the vault and Koresh was heard through a secret listening device saying, "there is no gas in here, send the women and children in here." Byron Sage said, this is one reason they inserted a greater amount of C.S. gas into the building near the vault. This explains why federal agents used the shape charge on the roof of the vault. They thought David Koresh would still be in the vault. Remember, they had direct orders from Washington to "Kill or capture David Koresh." The question is, how could they possibly use the shape charge knowing the women and children were in the vault and knowing it would kill all of them?
Sergeant First Class, Steven M. Barry, U.S. Army Special Forces, retired, stated, "The damage to the stainless steal refrigerator (in the vault) appears to have been under the blast hole is consistant with a shape charge, and the blast being directed downward into the room, an enclosed concrete room, would very likely cause some seem rupture and create a huge over-pressure inside the room that would pretty much kill everyone in there. Anyone who was under this device when it was blown would have been horribly mangled, probably dismembered, pretty much like being thrown into a grain thresher. Rather than risk your own people, going in there and trying to shoot it out with them, it's a standard tactic in city fighting in military operations and built up terrain to use explosives in this manner to kill people in a targeted manner that your going to attack."
Colonel Jack Frost stated, "Having examined still photographs and video tapes of the bunker, it was apparent to me that this was caused by a shape charge. What bothers me is who would have the audacity to use such a charge."
General Benton K. Partin (Brigadier General USAF, retired) stated, "What it tells me is that you had a demolition charge went off on the roof."
Evidence of Delta Force Gunfire
Senior Case Officer, Gene Cullen, Special Operations Group of the CIA
stated, "In mid March 1993, I attended a senior executive staff meeting at CIA headquarters and it involved senior agency management along with the liaison officers from the U.S. Military in particular form Delta Group. The briefing centered on Delta's operations in Waco, Texas. Originally, I was told that there was just going to be one or two Delta personnel there as observers, but during the meeting it was mentioned that there were over ten Delta observers at Waco and they were not there merely as observers, but would be participating in any type of operation or tactical effort against the Branch Davidians. Approximately a year after the Waco incident, I was deployed overseas in Europe and I had the chance to meet some of the Delta operators that I had seen on previous assignments. They had told me on several different occassions during my meetings in Europe that not only were they forewardly deployed at Waco, Texas, but they were actually involved in a gunfight with the Branch Davidians. There is no doubt in my mind that the flashes on FLIR tape was fired from a semi automatic or automatic weapon fire being returned into the building. I mean it's inconsistant to even think otherwise. There were people there on the ground with automatic weapons, and flashes such as that only come from one thing, and it comes from rifle barrels that are firing back into the building. We had heard during the meeting, various cenerios that they were going to use down in Waco, Texas to try to bring a speedy recovery or a speedy end to what was taking place down there, and at that timegas was talked about, a couple other non-lethal situations were talked about, and the primary concern around the table was a lot of the Branch Davidians that were inside the building were willing or did not want to end there life in such a fashion, especially the 17 children that were down there. It was discussed at the meeting that the senior levels of the Clinton administration had authorized Delta to be deployed to Waco, Texas, and not just two or three people deployed there, but enough people there to get the job done." Sergeant First Class, Steven M. Barry, U.S. Army Special Forces, retired,
stated, "I did talk to some Combat Applications Group guys and they did confirm that, yes, portions of the B squardran were there pulling triggers."
